Fountain Havens Limited (“Fountain Havens”, “we”, “us”) is the data controller for personal data collected through this website. We are registered in Nigeria with company number [RC NUMBER, to be supplied] at [REGISTERED ADDRESS, to be supplied].

This policy explains what we collect, why, and what rights you have under the Nigeria Data Protection Act 2023 (NDPA).

What we collect

We collect only what you give us, plus basic technical data:

  • Enquiry details, your name, email address, phone number, the city you are buying from, the development you are interested in, and whatever you write in your message.
  • Contact records, notes of calls, viewings and correspondence, so we can pick up a conversation where it left off.
  • Technical data, IP address, browser type, pages viewed and referring site, collected by our hosting provider in standard server logs.

We do not ask for financial details, identity documents or proof of funds through this website. If those become necessary at reservation stage, they are handled separately and under a specific agreement.

Why we use it

  • To respond to your enquiry and arrange viewings.
  • To keep you updated on a development you have registered interest in, including construction progress for off-plan reservations.
  • To meet our legal and regulatory obligations, including record-keeping and anti-money-laundering checks where they apply.
  • To keep the website secure and working.

Our lawful bases under the NDPA are your consent (for marketing updates), the performance of a contract or steps taken at your request before entering one (for enquiries and reservations), legal obligation, and our legitimate interests in running and securing the business.

Marketing

We will only send you marketing about new developments if you ask us to. Every such message carries an unsubscribe link, and you can opt out at any time by emailing info@fountainhavens.com. Opting out of marketing does not affect enquiries you have already made.

Who we share it with

We do not sell your personal data. We share it only with:

  • Service providers who operate the site and our email on our behalf (hosting, email delivery, analytics), under contract and only for those purposes.
  • Professional advisers, lawyers, surveyors, accountants, where a transaction requires it.
  • Regulators or law enforcement, where we are legally required to.

Some providers process data outside Nigeria. Where that happens we rely on the NDPA's cross-border transfer provisions and satisfy ourselves that an adequate level of protection is in place.

How long we keep it

Enquiries that do not lead to a transaction are kept for [RETENTION PERIOD, typically 24 months] and then deleted. Records relating to a completed purchase are kept for as long as required by Nigerian tax, property and anti-money-laundering law.

Cookies

This website uses only the cookies necessary to serve pages and keep them secure. It does not currently run advertising or third-party tracking cookies. If that changes, this policy will be updated and, where required, consent will be requested before any non-essential cookie is set.

Your rights

Under the NDPA you may:

  • ask for a copy of the personal data we hold about you;
  • ask us to correct anything inaccurate;
  • ask us to delete it, where no legal obligation requires us to keep it;
  • object to, or ask us to restrict, how we use it;
  • withdraw consent at any time, where consent is the basis we rely on;
  • ask for your data in a portable format.

To exercise any of these, email info@fountainhavens.com. We will respond within the statutory timeframe. If you are not satisfied, you may complain to the Nigeria Data Protection Commission (NDPC).

Security

We apply reasonable technical and organisational measures to protect personal data, including encrypted transport (HTTPS) and restricted access to enquiry records. No transmission over the internet is ever completely secure, and we cannot guarantee absolute security.

Changes

We may update this policy. The date at the top always reflects the current version, and material changes will be highlighted on this page.
